Client Portal Terms

The short agreement between you and Tairi B.V. for your use of the Faronto client portal, which your coach uses to work with you.

These Client Portal Terms (the "Portal Terms") govern your use of the Faronto client portal at app.faronto.com (the "Portal"). The Portal is operated by Tairi B.V., trading as Faronto, a private limited company incorporated under Dutch law ("Faronto", "we", "us").

We host the Portal on behalf of your coach so the two of you can schedule sessions, share materials, track goals and exchange notes in one place. You ("you") are a client of a coach who uses Faronto.

These Portal Terms are short on purpose. The coaching relationship itself is between you and your coach, not between you and Faronto: see Section 2.

1. About these terms

  1. Faronto provides the Portal software. Your coach has invited you to use it as part of working with them.
  2. These Portal Terms apply to your use of the Portal only. They do not replace any agreement you have with your coach for the coaching services themselves.
  3. The Faronto Terms of Use are a separate business agreement between Faronto and your coach. You are not a party to those Terms.

2. Your coach, not Faronto

  1. Your coach is responsible for the coaching itself: the methodology, the advice, the schedule, the fees you pay them, and the outcome of your sessions.
  2. Faronto is the software provider, not your coach. We do not coach you, we do not supervise your coach, and we are not party to your coaching arrangement.
  3. Questions about your coaching, your sessions, your invoices from your coach, or how your coach handles your personal information should go to your coach directly. We can help with technical issues with the Portal itself.

3. Using the Portal

  1. Your access to the Portal is personal to you, non-transferable, and lasts for as long as your coach keeps it active.
  2. You sign in with the email address your coach used to invite you. Keep your sign-in details private and do not share them. If you think someone else has used your account, tell us at support@faronto.com and tell your coach.
  3. You must be at least 16 years old to use the Portal. If you are under 16, ask your coach to manage your account instead.

4. Acceptable use

You agree not to:

  • Use the Portal in any way that breaks the law, infringes someone else's rights, or harms other users.
  • Upload or share content that is unlawful, abusive, defamatory, infringing or that contains another person's sensitive personal information without their permission.
  • Try to break, disable, overload or get around any security or authentication on the Portal, or scrape data from it beyond normal use.
  • Use the Portal to send unsolicited messages, malware or other harmful code.
  • Pretend to be someone you are not, or let someone else use your account on your behalf.

5. AI-generated content

  1. Some content in the Portal is generated or assisted by artificial intelligence (for example, summaries of your sessions or suggested next steps).
  2. AI output is a suggestion only. It can be incomplete, inaccurate or biased, and it is not medical, legal, financial or other professional advice.
  3. Your coach reviews AI-assisted content as part of their work. If something looks wrong, tell your coach.

6. Availability and "as is"

  1. We provide the Portal on an "as is" and "as available" basis. We do our best to keep it running, but we do not guarantee that it will be uninterrupted, error-free, or that any feature will keep working in its current form.
  2. We may add, change or remove features, and we may pause the Portal for maintenance. Where reasonable, we give your coach advance notice of significant changes so they can pass it on to you.
  3. To the maximum extent permitted by law, we disclaim all warranties that are not expressly stated in these Portal Terms, including warranties of merchantability, fitness for a particular purpose and non-infringement.

7. Our liability to you

  1. Nothing in these Portal Terms limits or excludes Faronto's liability for: (a) wilful misconduct or gross negligence; (b) death or personal injury caused by negligence; or (c) any liability that cannot be limited or excluded under mandatory law.
  2. Subject to clause 7.1, our total liability to you in connection with your use of the Portal is limited to EUR 100. The Portal is free for you (your coach pays for the software), so this cap reflects what is reasonable for a service you do not pay us for.
  3. We are not liable for any indirect, incidental or consequential loss, including loss of data, loss of opportunity or distress.
  4. We are not party to your coaching arrangement and are not liable for the outcome of your coaching, advice your coach gives you, or any payments between you and your coach.

8. Privacy

  1. Your coach is the data controller for the personal data you share with them through the Portal: they decide what to collect, why and for how long. Faronto acts as a data processor on your coach's behalf, under our Data Processing Agreement with them.
  2. Our full Privacy Policy explains what personal data we process, how we secure it, who our sub-processors are, and your rights under the GDPR. Please read it.
  3. If you want to exercise a data-protection right (access, correction, deletion, portability), contact your coach in the first instance. If you cannot reach your coach, contact us at privacy@faronto.com and we will help you reach them.

9. When access ends

  1. Your access to the Portal ends when your coaching arrangement ends, when your coach removes your access, when your coach's account with us ends, or when you ask to close your Portal account.
  2. After your access ends, your coach may keep records related to your coaching (notes, invoices, session history) in line with their own legal and professional obligations. Ask your coach what they keep and for how long.
  3. We may suspend or end your access immediately if you breach Section 4 (Acceptable use), if we are required to by law, or if we reasonably believe your use poses a security or legal risk.

10. Changes, governing law and contact

  1. We may update these Portal Terms over time. If we make a material change, we will ask you to accept the updated terms the next time you sign in to the Portal.
  2. These Portal Terms are governed by the laws of the Netherlands. Any dispute will be submitted to the competent court of Amsterdam (Rechtbank Amsterdam), without prejudice to any mandatory consumer-protection rules that apply where you live.
